Kochi scooter crash kills rider; police investigate minor driver
A Kochi scooter crash killed a 55-year-old rider in Cheranalloor in the early hours of Sunday, police said, alleging that a car driven by a minor struck his two-wheeler. Investigators are examining the teenager's role and whether the vehicle's registered owner bears liability.
The deceased, Jayabalakrishnan of Manjali, operated a street food cart in Kochi's Chittor area. His family said he was travelling home after closing the cart when the collision occurred at about 2.30 am.
Police took the teenager into custody and arranged a medical examination before producing him before the Juvenile Justice Board. He was subsequently released under provisions of the Juvenile Justice Act, according to the police account.
The car was registered to the minor's father, police said. They said a decision on proceedings against the registered owner would be made as the investigation progressed.
Police examine charges and medical evidence
In the Kochi scooter crash case, police registered an offence under Section 106 of the Bharatiya Nyaya Sanhita. The provision concerns causing death through a rash or negligent act that does not amount to culpable homicide.
Cherannalloor Circle Inspector Shyam Kumar said blood samples had been collected for testing. He said an initial assessment did not indicate intoxication and that the teenager had been alone in the vehicle.
The officer said further inquiries would determine whether culpable homicide provisions could apply. Police would consult the Juvenile Justice Board before including non-bailable provisions, he added.
Relatives disputed any suggestion that Jayabalakrishnan had been driving carelessly and alleged that the car hit his scooter from behind at speed. Those assertions form part of the family's account.
State Home Minister Ramesh Chennithala assured the family of strict action and said prominence or influence would not affect the investigation.
