Imran Khan plans Bombay High Court challenge to order directing him to leave India
Actor Imran Khan intends to challenge an order requiring him to leave India by October 28, his lawyer Parvez Memon said in Mumbai. The legal team plans to approach the Bombay High Court on Friday over action linked to his participation in a city protest.
Khan, an Overseas Citizen of India cardholder who reportedly holds an American passport, was detained during the demonstration at August Kranti Maidan. The gathering demanded the resignation of Chief Election Commissioner Gyanesh Kumar.
Memon disputed the basis for action against the actor, saying the rules do not prevent OCI cardholders from joining protests. Advocates Zulfiquar Memon and Chirag Naik are also representing Khan alongside him through MZM Legal LLP.
The order followed complaints from BJP leader Kirit Somaiya, who alleged that Khan's involvement in the demonstration breached immigration rules and visa conditions. These remain allegations disputed by the actor's legal team.
Somaiya submitted an application at Gamdevi police station on Monday seeking action against Khan. Police then sent it to the Foreigners Regional Registration Office for consideration, according to the account of the proceedings.
An official confirmed that Khan had been instructed to depart by October 28. The official maintained that the competent authority had found violations of the law governing foreign nationals, while Memon said the order would be contested.
Somaiya also sought the actor's detention and deportation, alleging misuse of his OCI privileges. He said he had provided police with material concerning Khan's remarks and participation in the protest.
Khan has said he attended as a Mumbai resident and did not arrive with specific demands. OCI status gives foreign nationals specified privileges, including a lifelong visa allowing repeated visits, but those benefits remain subject to the applicable rules.
