Anil Tuteja bail challenge declined; state can seek cancellation for misuse
The Anil Tuteja bail challenge brought by Chhattisgarh was declined by the Supreme Court on Thursday, October 29. The judges nevertheless allowed the state to approach the high court for cancellation if the retired IAS officer misuses the relief granted in corruption cases.
A bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana heard the state’s arguments against the high court orders. Those orders, issued in December 2025 and January 2026, had granted Tuteja bail in fresh corruption cases.
The Supreme Court said observations made by the high court were confined to its consideration of bail. They must not shape the trial court’s assessment of the cases, the bench clarified.
Cancellation route remains available
The judges distinguished suspicion of involvement in corruption from evidence sufficient to establish it. They said the state could bring any instance of misuse to the high court’s attention when seeking cancellation.
The ruling on the Anil Tuteja bail challenge therefore leaves the existing relief in place while preserving that route for the government. It does not decide whether the corruption allegations against him are proved.
Tuteja held senior positions during the Bhupesh Baghel government and faces investigations involving an alleged liquor scam, suspected District Mineral Fund irregularities and a coal levy case. Those matters remain allegations under investigation.
The state’s Economic Offence Wing and Anti-Corruption Bureau recently submitted a tenth supplementary charge sheet in the alleged liquor scam. It listed 20 people and 22 companies as accused, according to the report.
The Supreme Court had separately granted Tuteja bail on May 18 in a corruption case concerning alleged District Mineral Fund irregularities. He had been in custody from January 24, 2024, in connection with various corruption cases before obtaining bail.
